WA: Robert French AC Oration by The Hon Justice James Edelman, Justice of the High Court of Australia – 27 September 2018

Aristotle and the equity of statute law featured prominently in the recent WA HAL Chapter Robert French AC Oration.

The Hon Justice James Edelman, Justice of the High Court of Australia, delivered the Oration to a large crowd of HAL members and guests on 27 September 2018 in Court No. 1 at the Supreme Court of Western Australia.

His Honour’s Oration, titled “Aristotle and the Equity of Statute Law”, was followed by a reception for members and guests.

The National President of HAL, Mal Varitimos QC, said in his address that it was an honour and fitting to have the Robert French AC Oration delivered by Justice Edelman. Both Justice Edelman and Mr French AC were both recognised as outstanding jurists from Western Australia.

Mr Varitimos observed that Mr French AC was regarded by HAL members as a great Philhellene and it was a privilege to name the WA Chapter Oration after him.

Thanks were also extended in the evening to the generous sponsorship provided by Vertannes Georgiou Lawyers.

NT: Chapter Oration by The Hon Michael Grant, Chief Justice, Supreme Court of the Northern Territory – 21 September 2018

Provisions of the Constitution relevant to citizenship were central to the theme of the recent  inaugural Oration of the NT Chapter of HAL

The Oration was delivered by the Hon Michael Grant, Chief Justice, Supreme Court of the Northern Territory on 21 September 2018.

A large audience of HAL members and guests enjoyed his Honour’s Oration titled “Exclusion from Representative Office on the Basis of Allegiance, Obedience or Adherence to a Foreign Power” at the Northern Territory Supreme Court in Darwin, including from interstate Maria Barbayannis, Australian Vice president of HAL and her husband, Michael Barbayannis.

HAL member Mr Tass Liveris, introduced the Hon Chief Justice, Michael Grant and delivered a speech of welcome to those attending at the inaugural NT Chapter Oration, highlighting an important purpose of the Association and that is to provide continuing legal education and the exchange of legal information.

Following the Oration guests enjoyed a drinks and canapé reception in the  Supreme Court foyer.

The evening was a success!

SA: The John Perry Oration for 2018 – 24 August 2018

The Fourth Annual SA John William Perry AO QC Oration was hosted by the South Australian Chapter of the Hellenic Australian Lawyers Association (HAL), in association with Leventis Lawyers, and Serafino Wines, on Friday 24 August 2018 at The Adelaide Pavillion in Veale Gardens, South Terrace, Adelaide.

The Perry Oration is an annual dinner and oration hosted by HAL to celebrate the life and contribution of the late Honourable Justice Perry, who served as a judge of the Supreme Court for 19 years.

Approximately 150 guests enjoyed three courses of contemporary Greek cuisine paired with McLaren Vale wines kindly supplied by Serafino, and accompanied by traditional live Greek music.

Attendees included the Honourable Justice Keane of the High Court of Australia, the Honourable Chief Justice Kourakis, the national patron of HAL, judges of the Federal, Supreme, and District Courts, current and former Ministers of Parliament, and members of the profession.

Keynote speaker, Keane J, delivered a thought provoking speech entitled “Socrates and the Athenians: Gadflys and Freedoms of Speech and Association“.

His Honour traced the complex tensions that exist between the right to freedom of speech and association, and the countervailing considerations to delimit those freedoms in the interests of the community as a whole.

His Honour drew as an exemplar of the social and intellectual gadfly the trial of Socrates in 399BC held to determine his guilt of two charges namely asebeia (impiety) against the pantheon of Athens, and corruption of the youth, by his failing to acknowledge the gods that the city acknowledged and the introduction of new deities.

Socrates’ entirely peaceful conduct was contrasted with that in Snyder v Phelps 562 US 443 (2011) whereby the Supreme Court of the United States of America protected the content of placards displayed by self-proclaimed gadflies at the funeral of a marine which on the basis that, even though outrageous, they were unable to found liability in tort in view of the First Amendment to the United States Constitution.

The basis of that decision was then contrasted with the decision of the High Court in Coleman v Power (2004) 220 CLR 1, in which gadfly Mr Coleman had handed out flyers accompanied by “insulting words” alleging corruption in the Queensland Police Force, and an analysis of the bases for different results in similar cases in Australia.

The HAL Committee also reported on the success of the 2018 HAL International Conference held in Rhodes, Greece, in July 2018, and announced that a further conference is planned for Rhodes, Greece in 2020.

NSW: Inaugural Chapter Oration delivered by The Hon Justice Stephen Gageler AC – 20 August 2018

The inaugural NSW Chapter Oration explored the concept of truth within our common law system and the relationship between that concept of truth and the concept of justice.

The Hon Justice Stephen Gageler AC of the High Court of Australia delivered the Oration on 20 August 2018.

A large audience of HAL members and guests enjoyed His Honour’s Oration, titled “Truth and Justice and Sheep” at the Federal Law Courts Building in Sydney.

His Honour’s paper, titled “Truth and justice and sheep“, can now be downloaded from the HAL website.

The HAL NSW Chapter Patron, The Hon Justice Melissa Perry, introduced the Hon Justice Gageler AC.
